Rules - Get Into the Festive Spirit – 4th edition

1. Contest Period 

1.1 The contest entitled Get Into the Festive Spirit – 4th edition (hereinafter referred to as the “Contest”) is administered by Automobile et Touring Club du Québec (A.T.C.Q.) doing business under the name CAA-Quebec (hereinafter referred to as the “Contest Organizer”). The Contest begins on November 20, 2024, at 0:00a.m. and ends on December 10, 2024, at 11:59p.m. 

2. Eligibility 

2.1 To be eligible for this Contest, entrants must be CAA-Quebec members, they must have reached the age of majority in the province of Quebec at the time of entry, and they must reside in Quebec. 

2.2 Employees, representatives, and mandataries of the Contest Organizer, its affiliates and subsidiaries, advertising and promotional agencies, sponsors and suppliers of materials, prizes and services related to the Contest, as well as any person domiciled with the aforementioned (whether related to the person or not) and any member of their immediate family (father, mother, brother[s], sister[s], children, partner or spouse by the bonds of marriage or de facto) are, however, not eligible to enter this Contest. 

2.3 For the purposes of these rules, the entrant is the person whose name appears on the entry form or text, as the case may be. 

3. How to enter 

3.1 No purchase necessary to enter or win.  

3.2 Pour participer au Concours, le participant doit procéder de l’une ou l’autre des manières décrites ci-dessous :

a) Online entry: (i) go to caaquebec.com/en/contests and complete the online entry form; (ii) confirm they have read the Rules and undertake to abide by them; and (iii) submit the entry form by clicking “I Enter.” 

OR

b) Mail-in entry: (i) write a one hundred (100)-word original handwritten text explaining why they want to win one of the Contest prizes described in these Rules; (ii) indicate their name, complete address (including postal code), telephone number (including area code) and email address at the end of the text; and (iii) sign and mail the text to: Get Into the Festive Spirit – 2nd edition Contest, Marketing Department, CAA-Quebec, 444 Bouvier Street, Québec, QC, G2J 1E3, no later than December 3, 2024. The content of the entry text submitted must be unique and photocopies are not accepted. 

3.3 The Contest Organizer cannot be held responsible for late, lost, misdirected, or incomplete entries. 

3.4 Les participants doivent respecter la limite suivante, à défaut de quoi ils pourront être disqualifiés : une (1) seule participation par personne et par adresse courriel, pour toute la durée du Concours.

4. Prizes

4.1 There are a total of six (6) prizes to be won: one (1) Grand Prize and five (5) Secondary Prizes. 

Grand Prize 

  • One (1) package worth up to $500 from Ôrigine artisans hôteliers, at the winner’s choice

  • $500 gift card from Shell

  • $150 from the CAA-Quebec Boutique as a special promotional code, redeemable online only 

Secondary Prizes:   

  • One (1) $150 electronic gift card from Stokes and $50 from the CAA-Quebec Boutique as a promotional code, redeemable online only 
  • One (1) $150 electronic gift card from RW&CO. and $50 from the CAA-Quebec Boutique as a promotional code, redeemable online only
  • One (1) $150 gift card from NAPA Auto Parts and $50 from the CAA-Quebec Boutique as a promotional code, redeemable online only
  • One (1) $150 electronic gift card from Omy Laboratoires and $50 from the CAA-Quebec Boutique as a promotional code, redeemable online only
  • One (1) $150 gift card from Shell and $50 from CAA-Quebec Boutique as a promotional code, redeemable online only 

4.2 Prizes are non-negotiable and must be accepted as awarded, without any warranty.   

4.3 Prizes may not be substituted for another prize, except by the Contest Organizer in its sole discretion. The Contest Organizer reserves the right to substitute any prize with a prize of equal or greater value if a prize cannot be awarded as described herein for any reason whatsoever. 

4.4 Prizes may not, in whole or in part, be transferred to another person or exchanged for cash. 

4.5 The Contest Organizer, its affiliates and subsidiaries, their advertising and promotional agencies, the sponsors and suppliers of materials, prizes and services in connection with this Contest, as well as their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns shall in no event be required to award more prizes than indicated in these Rules or to award a prize other than in accordance with these Rules. 

4.6 Prizes are subject to the following conditions: 

a) The Ôrigine package is subject to the following conditions:    

  • A representative of Ôrigine artisans hôteliers will contact the winner. The winner will be asked to provide 5 choices of establishments in the network in which they would like to stay. A certificate will be awarded based on their choices, subject to availability.  

  • The package is a stay for 2 people worth approximately $500. It must be used in its entirety, is non-cashable, non-exchangeable and non-transferable. Any costs or expenses other than those specifically stipulated as being included in the package will be charged to the recipient.

  • The value of the package is subject to change without prior notice.

  • Responsibility for honouring the certificate is assigned to the member establishment. Ôrigine artisans hôteliers accepts no responsibility for any restrictions or services provided by the hotelier. If, for any reason, the establishment is no longer a member, Ôrigine artisans hôteliers undertakes to replace this certificate with one from a member establishment in good standing. 

b) The NAPA Auto Parts gift card is valid for in-store purchases only. It is not valid for online purchases. 

5. Selection of potential winners

5.1 The random draw to select the respective winners of each of the six (6) prizes will be held on Friday, December 13, 2024, at 2:00p.m. at the Contest Organizer’s head office, located at 444 Rue Bouvier, Québec, Quebec G2J 1E3.

5.2 The odds of winning depend on the number of eligible entries received during the Contest Period.

6. Awarding of the prizes

6.1 In order to be declared a winner and claim their prize, the entrants selected during the random draws must:

a) Be contacted, by telephone or email, by the Contest Organizer or its representatives, within five (5) business days of the draw. When the Contest Organizer contacts the selected entrants, whether by telephone or email, the selected entrants must comply with the instructions given to them by the Contest Organizer or its representatives, as the case may be. If the Contest Organizer receives an email notification stating that its message could not be delivered, it may, at its sole discretion, attempt to reach the entrant by telephone or disqualify such entrant; 

b) Correctly answer the mathematical skill-testing question indicated on the release form provided by the Contest Organizer; 

c) Duly complete and sign the release form and return it, within five (5) days following its receipt, to the Contest Organizer, either (i) by email, in scanned format, or (ii) by mail, to the mailing address indicated in the instructions set forth on the release form; 

d) Meet all the Contest’s conditions set out in these Rules; and

e) Upon request and in a timely manner, provide photo identification. 

6.2 Failure to comply with any of the above-mentioned conditions, or any other condition set out in these Rules, will result in the selected entrant’s entry being declared null and void and a new draw will be held in accordance with these Rules in order to award the prize concerned.

6.3 Information provided by any selected entrant when contacted by the Contest Organizer must be complete and truthful. The Contest Organizer cannot be held responsible for any late, misdirected, or incomplete prize claims. 

6.4 In the event that (i) the Contest Organizer or its representatives are unable to contact a selected entrant within five (5) business days of the draw, after taking reasonable measures to do so; or (ii) the selected entrant fails to return the release form within the allotted time; or (iii) the selected entrant mentions refusing the prize or not being interested in receiving the prize, or is being rude or aggressive towards the Contest Organizer or its representatives when contacted by the Contest Organizer or its representatives; or (iv) the selected entrant does not abide by these Rules; then the said selected entrant will be disqualified and the Contest Organizer may, at its sole discretion, cancel the prize concerned or proceed with another random draw in accordance with the Terms and Conditions set forth in these Rules, until a winner is identified for the prize concerned.

7. General provisions

7.1 By entering this Contest, entrants automatically agree to abide by these Rules. Failure to comply with the Terms and Conditions set forth in these Rules, as well as rudeness or aggressiveness on the part of an entrant towards the Contest Organizer or one of its representatives, as the case may be, may result in disqualification of such entrant.

7.2 Entry forms and any other documents submitted to enter this Contest, as well as release forms, may be subject to verification by the Contest Organizer. Any document that is incomplete, illegible, incomprehensible, fraudulent, mutilated, registered or sent late, bearing an invalid email address or phone number, not indicating the correct answer to the mathematical skill-testing question, if applicable, or that otherwise does not comply with these Rules will be automatically rejected and will not entitle the entrant to enter the Contest or to win a prize, as applicable. 

7.3 Entry forms and any other documents submitted to enter the Contest, as well as release forms, are the property of the Contest Organizer and will not be returned to entrants under any circumstances. 

7.4 By entering this Contest, entrants consent to the disclosure, publication and/or use of their name, photographs, videos, likeness, place of residence, voice, comments and/or statements for advertising, publicity, marketing and informational purposes in any and all media (including the Internet), throughout the world, in perpetuity, and in any format, in connection with the Contest or similar contests in the future, without notification and without any form of compensation or remuneration.  

7.5 The Contest Organizer assumes no liability for any damage or loss that may arise directly or indirectly, in whole or in part, from the use of caaquebec.com or the transmission of information in connection with this Contest. 

7.6 Any person who enters or attempts to enter this Contest releases and hold harmless the Contest Organizer, sponsors, participating partners, advertising and promotional agencies, suppliers of materials, prizes, and services in connection with this Contest, as well as their respective affiliates and subsidiaries, and their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns, from and against any and all liability and damages of any kind whatsoever that such person may incur or that may arise from such person’s entering or attempt to enter this Contest, and/or the awarding, acceptance and/or use or misuse of a prize. 

7.7 The Contest Organizer reserves the right to disqualify an entrant from this Contest or to cancel any and all entry of an entrant if such entrant enters or attempts to enter this Contest by using any means that is contrary to these Rules or that is unfair to the other entrants (for example: use of automated equipment to enter the Contest, hacking, entering beyond the permitted limits, etc.). Such entrant may be reported to the appropriate legal authorities.  

7.8 ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST CONSTITUTES A VIOLATION OF CIVIL AND CRIMINAL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST ORGANIZER RESERVES THE RIGHT TO REJECT THE ENTRANT’S ENTRIES AND TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. 

7.9 In the event that the system is unable, during the Contest Period, to register all the entries to the Contest, for any reason whatsoever, or if the Contest is terminated, in whole or in part, prior to the end date provided for in these Rules, the draws may be made, at the Contest Organizer’s discretion, from among the entries duly registered during the Contest Period or, as the case may be, up to the date of the event that terminated participation in the Contest. 

7.10 No communication or correspondence will be exchanged with entrants to this Contest other than in accordance with these Rules or at the Contest Organizer’s initiative. 

7.11 Personal information collected from entrants in connection with this Contest will be used solely for the purpose of administering the Contest. No communication, commercial or otherwise, unrelated to this Contest will be sent to entrants unless they have otherwise consented to such communication. By entering this Contest, entrants agree the Terms and Conditions set forth in the Contest Organizer’s Privacy Policy. 7.12 If a section of these Rules is held by a court of competent jurisdiction to be illegal, unenforceable, or invalid, then such section shall be deemed not to be a part of theses Rules, it being understood that all unaffected sections shall be enforced to the fullest extent permitted by law. 

7.13 In the event of any discrepancy or inconsistency between the French-language version and the English-language version of these Rules, if any, the French-language version shall prevail, govern and control. 

7.14 The Contest is subject to all applicable federal, provincial and municipal laws. 

7.15 Any decision by the Contest Organizer and its representatives regarding the Contest is final and without appeal. 

7.16 The Contest Organizer reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest, in whole or in part, should a human intervention or an event take place that could alter or affect the administration, security, impartiality, or conduct of the Contest.
